This won't change the story that much at all but I think BlogTV uses the State of New York fair use policy (USA Goverment) The BlogTV TOS Reads

"b) Jurisdiction and governing law - These Terms of Use shall be governed by the internal substantive laws of the State of New York, without respect to its conflict of laws principles. The Website shall be deemed a passive website that does not give rise to personal jurisdiction over BlogTV, either specific or general, in jurisdictions other than the State of New York. Any claim or dispute between you and BlogTV that arises in whole or in part from this Website shall be decided exclusively by a court of competent jurisdiction located in New York."

Copyright laws in the USA are Federal Laws, not state laws. that caluse only means for state offences, Federal Laws may be seen in the state where the Federal laws were broken.

This matter is a Federal matter, not a state or civil matter.

Copyright laws are govenerned by the Federal laws not city or state.
